Livingston et al. v. Trane U.S. Inc., No. 2:17-cv-06480-ES-MAH

The Final Approval Hearing was held on August 12, 2020 and the Settlement was approved and is now effective. The claims filing deadline is September 25, 2020. Claims will continue to be processed. Please be patient during this phase of the administration. In addition, the free Preventive Injection Program is available now until September 11,2021.

If you purchased or currently own a Trane or American Standard air conditioner or heat pump, your rights may be affected, and you may be entitled to benefits under this class action settlement.

To determine if your air conditioner or heat pump is included in the class, please check whether the serial number of the outdoor unit of your air conditioner on the list here or enter your serial number below.



Under the settlement, Trane U.S. Inc. has agreed to:

  • Reimburse out-of-pocket costs that Class Members incurred to repair or replace a stuck thermostatic expansion valve or "TXV"; 
  • Provide a free Additive to prevent potential future problems and a labor allowance to inject it; and
  • Provide Enhanced Compressor Warranty Coverage for certain units.

You must make a claim to receive some of these benefits. The deadline to file claims is September 25, 2020. Even if you are unsure if your unit is in the class, you should submit a claim.

YOUR RIGHTS AND OPTIONS IN THIS SETTLEMENT

Submit a Claim 

Reimbursement for out-of-pocket expense: You must submit a Claim to get a reimbursement.

Enhanced Compressor Warranty Coverage: You must submit a Claim Form to claim this benefit unless you received a notice specifically stating that Trane's records already reflect that you received a Qualifying Additive Injection.

Deadline:

September 25, 2020

Preventative Additive Injection

Preventative Injection: Contact any local Trane/American Standard service provider or dealer and reference bulletin number UN-SVB020H-EN. The deadline to get the injection is September 11, 2021.

Deadline:

September 11, 2021

Exclude Yourself

This is the only option that allows you to keep your right to sue Trane about the claims in this case. But you will not get any benefits from the Settlement.

Deadline:

Received by July 13, 2020

Object

Tell the Court about why you do not like the Settlement.

Deadline:

Received by July 13, 2020

Do Nothing 

 You will get no benefits from the Settlement (unless Trane's records show you had a Qualifying Additive Injection).
